Legal Aid Eligibility

Legal Aid eligibility varies depending on what area of law you require help with.

If your child is subject to care proceedings initiated by the Local Authority or they have invited you to a “pre-proceedings” meeting, you will be eligible for legal aid which is not means or merits tested and means you qualify automatically by virtue of being a parent or having parental responsibility for the child in proceedings.

If you are going to Court for an application for a Child Arrangements Order or Financial Order, legal aid is means and merits tested.  This means you have to be financially eligible to qualify and you must also satisfy the ‘merits’ test by having evidence of domestic abuse or evidence that your child is at risk of harm from the other party.

If you require protection from domestic abuse through either a Non-Molestation Order or Occupation Order, legal aid is means and merits tested but you do not need to have evidence of domestic abuse to apply.  Instead, you need to be able to show that the application is justified, and you require protection by way of a Court order.

We also hold a legal aid contract for Clinical Negligence. This is only available in cases where a child has suffered a severe brain injury during pregnancy/childbirth or shortly afterwards. These are exceptional cases, but our lawyers will consider all funding options with you at the outset of your case.
