What is No Win No Fee in Medical Negligence?

I'm sure you've probably heard of 'No Win No Fee' Solicitor's, they have probably also been referred to as ambulance chasers. But this is an unfortunate stereotype of medical negligence lawyers. 'No Win No Fee' Solicitors are not ambulance chasers; it is an incredibly reputable arrangement that benefits you as a client immensely.

'No Win No Fee', known as a Conditional Fee Agreement or CFA is an arrangement between you and your solicitor. It is an agreement that means that if your claim is unsuccessful then you will not have to pay any legal costs.

For you to be offered a 'No Win No Fee' agreement in medical negligence, our solicitors will take some details of your claim and make an assessment on its likelihood of being successful. If we believe that there is a good chance of success we will enter into a 'No Win No Fee' Agreement with you. We will not charge any fees throughout the course of your claim as long as you, as the client, act honestly and instruct us promptly.

What happens if my claim is successful?

If your claim is successful, you will keep the majority of the compensation awarded to you. The defendant will be ordered to pay most of the costs that were incurred throughout the course of your claim, however, you will have to pay a small amount from your compensation for costs incurred. The amount of compensation you will receive and the amount that you would have to contribute would depend entirely on the circumstances of the case.

You will be informed from the outset on the percentage you will have to pay and you will be kept informed throughout the case of what is happening; so you can rest assured you will not have any hidden costs or unexpected fees.

What happens if my claim is unsuccessful?
